These Terms of Service ("Terms") govern your use of buyfirestop.com and any quote, order, or product support you request from American Fire Safety Supply LLC ("AMFSS," "we," "us," or "our"). By accessing this site or requesting products or services from us, you agree to these Terms. If you do not agree, do not use the site.
1. Who We Are
American Fire Safety Supply LLC is a Texas-based distributor of firestop, marine, and industrial safety products. Our registered business address and contact information are available upon request at legal@amfss.com. We sell to both businesses (B2B) and individual consumers in the United States and internationally where permitted.
2. Use of This Site
You may use this site for lawful purposes only. You agree not to:
- Scrape, harvest, or systematically download product data or pricing without our written consent;
- Use the site to transmit spam, malware, false requests, or fraudulent order information;
- Attempt to gain unauthorized access to our systems or customer data;
- Reproduce or redistribute our product content, images, or descriptions for commercial use without permission.
We reserve the right to suspend or terminate access for violations of these Terms.
3. Product Descriptions and Accuracy
We make reasonable efforts to ensure product descriptions, specifications, images, and compatibility information are accurate. However, manufacturer specifications and installation details in official data sheets and system approvals are authoritative. Product images are representative; packaging and labeling may vary. If you have questions about a product's suitability for a specific application, contact us before ordering or specifying a product.
4. Pricing and Quotes
BuyFireStop is quote-first. Prices, lead times, and product availability are subject to confirmation. Catalog pages, product pages, and request forms do not constitute binding offers. A formal quote, invoice, purchase order acceptance, or other written confirmation from AMFSS is required before an order is accepted.
We reserve the right to correct pricing errors and decline requests or orders where information is incomplete, inaccurate, unavailable, or otherwise unsuitable for fulfillment. Tax-exempt customers must provide a valid exemption certificate before tax treatment can be confirmed.
5. Orders and Acceptance
Submitting a quote request does not create an accepted order. An order is accepted only when AMFSS confirms it in writing, issues an accepted invoice, receives and accepts a purchase order, or otherwise confirms acceptance. We reserve the right to decline or cancel any request or order for any reason, including stock unavailability, suspected fraud, pricing errors, or inability to confirm product suitability or shipping terms.
6. Order Cancellation
Orders may be cancelled without charge only if cancellation is accepted before procurement, production, allocation, or shipment begins. To request cancellation, contact us promptly at orders@amfss.com with your order or quote reference. Special-order, custom, or made-to-order items may not be cancellable once production or procurement has begun.
7. Delivery and Freight
Delivery method, freight terms, delivery timing, and risk-of-loss terms are confirmed during the quote or order process. Estimated delivery times are not guaranteed unless AMFSS expressly confirms a guaranteed service in writing. We are not responsible for delays caused by carrier issues, weather, customs clearance, incorrect delivery information, or events outside our reasonable control. Freight damage claims must be noted on the delivery receipt and reported to us promptly.
8. Returns and Exchanges
Returns require prior authorization from AMFSS. Where accepted, returned items generally must be unopened, resalable, and in original undamaged packaging. Restocking fees may apply to non-defective returns. Return freight costs are the customer's responsibility unless the return is due to our error or a confirmed defective product. Hazardous materials, regulatory-restricted products, special-order products, custom products, and made-to-order items may not be returnable.
To request a return, email orders@amfss.com with your order reference and reason. Do not ship returns without a return authorization.
9. Warranties
Products sold by AMFSS carry the manufacturer's warranty, if any. AMFSS does not separately warrant products beyond what the manufacturer provides. We will reasonably assist customers in pursuing valid manufacturer warranty claims. AMFSS makes no warranty that products are suitable for any particular application; it is the buyer's responsibility to verify compliance with applicable codes, standards, system listings, and the authority having jurisdiction (AHJ).
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMFSS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE OR PRODUCTS PURCHASED FROM US, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A TRANSACTION SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability that cannot be excluded by applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising from these Terms or a transaction with AMFSS shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
12. Dispute Resolution
We prefer to resolve disputes informally. If you have a concern, contact us at legal@amfss.com and we will make a good-faith effort to resolve it. If informal resolution fails, disputes shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive or other equitable relief in court. The arbitration shall be conducted in Texas, or by telephone/video if mutually agreed. You waive the right to participate in a class action.
13. Intellectual Property
All content on this site, including text, images, logos, product descriptions, and code, is owned by AMFSS or used with permission. You may not reproduce or use our content for commercial purposes without written authorization. Manufacturer product names, logos, and trademarks belong to their respective owners.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify affected customers by email.
